Judge Rejects Autism Defense in Kohberger Death Penalty Case

Apr 26, 2025 | Government, Law

Attorneys for Bryan Kohberger, accused of murdering four university students, argued that his autism should prevent a death penalty. A clinical neuropsychologist found Kohberger with Autism Spectrum Disorder, level 1. Kohberger’s defense cited the Eighth Amendment against cruel punishment. However, prosecutors indicated that only intellectual impairments can exempt the death penalty.

  • Kohberger was a criminal justice graduate student at the time of the crime.
  • Judge Steven Hippler rejected the defense’s request, allowing capital punishment if convicted.

The ruling marks a significant defeat for the defense team.

Lucem News Editor’s Opinion: The left has spent years trying to excuse bad behavior with pop psychology, but sorry — autism isn’t a “get out of death row free” card when you’re accused of brutally killing four people. Actions still have consequences, even in 2024.
