- Order 14173: Requires federal grant recipients to certify they do not operate DEI initiatives.
Judges Harris, Diaz, and Rushing emphasized that the orders’ enforcement could raise constitutional concerns, particularly regarding free speech and due process. Plaintiffs argue these orders exceed presidential authority, chilling speech and creating confusion.
