Judges Unite to Halt NYC Noncitizen Voting

Mar 20, 2025 | Elections, Government, Law

Liberal and conservative judges on New York’s highest court unanimously rejected a law allowing noncitizens to vote in local elections.

The New York City Council passed the law in December 2021, which could have enfranchised nearly 800,000 noncitizens. The New York Court of Appeals struck it down with a 6-1 ruling.

  • The court cited Article II of the state constitution, which restricts voting to citizens.
  • Mayor Eric Adams had allowed the bill to become law without a veto.
  • A lawsuit followed, asserting the constitution’s citizen-only voting provision.

This decision will impact the noncitizen voting debate.
