Congressman Seeks Judge Removal Using Constitutional Clause Instead of Impeachment

Apr 2, 2025 | Health, International, Science

Rep. Andy Biggs has proposed a novel legislative approach to remove U.S. District Judge James Boasberg without resorting to impeachment, leveraging the “good behavior” clause from Article III, Section 1 of the Constitution. Boasberg is known for blocking President Trump’s efforts to deport Venezuelan gang members. Biggs’ resolution seeks to enforce the constitutional provision that allows removal of federal judges for failing to uphold good conduct.

  • This action bypasses the traditional impeachment process, which requires two-thirds Senate approval.

Biggs emphasizes that federal judges do not necessarily have lifetime tenure.
